Except if otherwise required by law the following terms and conditions and our Privacy Statement and Policy, govern your use of the Website and/or the purchase of products from us. They describe the rights and responsibilities of both you and the Company. If you use the Website, or purchase products from us, you agree to be bound by these terms and conditions. If you do not agree to the terms and conditions, and our Privacy Statement and Policy, do not use the Website or purchase products from us.

The use of the website is on an “as is” basis and is used entirely at your own risk. We shall not be responsible for any detriment incurred by reliance you place on this Website or its contents.

Some product photos on this website are file photos only and therefore may not exactly match the product to be purchased. Please ensure you read and understand the description and / or features of each product before purchase.

Left hand (LH) and right hand (RH) descriptions are based on standing at the rear of the vehicle looking forward. For Australian right hand drive vehicles this means RH is the drivers side and LH is the passenger side.

Because of frequent changes in internet technology and applicable law we reserve the right to make changes to these terms and conditions at any time.

The Company may make changes in the products described, and to other content of the Website, at any time without notice. We make every effort to ensure that product descriptions on our Website are accurate. However, some inaccuracies, such as typographical errors or misinterpretations, may occur. We reserve the right to correct such inaccuracies or typographical errors as they are identified. All depictions contained on the Website, or in any catalogue, are for illustration purposes only.

The price displayed for products on the Website represents the full price, including GST (Goods and services tax), for the product itself, but does not include postage/delivery charges which will depend on the destination and the size/weight of the product. We always seek to provide products at the most competitive prices and reserve the right to change prices displayed for products on our website at any time. All of our prices are in Australian dollars (AUD).

Material contained on the Website may be protected by copyright. You may use the Website for personal and non-commercial purposes. You must not use, copy, distribute, transmit, store or publish any material on this web site, without obtaining our prior written consent. Registered trade-marks and logos must not be used or modified in any way without obtaining the prior written consent of the owner of the trade- mark or logo. Select product you wish to purchase by clicking the “Add to Cart” button. If you wish to have the product anodised please select and “Add to Cart” the appropriate “Anodised Optional Extra…..” item found in the store for each category. Complete the checkout process to finalise the purchase.

When you place an order with us you have made an offer to purchase the product that you have chosen. You can place an order, via the Website, by clicking the “Add to Cart” button. When you have completed the check out process and we receive payment it is deemed we have accepted your offer. Both the offer and acceptance are based on these terms and conditions. In order to prevent credit card or payment fraud, your offer can only be accepted by us after it has passed our validation procedures. We retain discretion to cancel orders if our processes identify any attempt at fraud or for any other legitimate reason. If for any reason we cannot process or accept your order after payment is received, we will contact you by email or telephone to determine your requirements for the reimbursement of money paid.

Please Note:  Delivery dates are a best estimation. Delays can occur, particularly with custom machining work. We strive to keep this to a minimum and thank you for your understanding.

We only accept payment through PayPal and Credit cards (Visa, MasterCard). Payment will not be processed until we have received all relevant information required for processing to be completed.

When purchasing the Company your financial details are passed through a secure server using the latest 128-bit SSL (secure sockets layer) encryption technology.128- bit SSL encryption is the current industry standard.

Items purchased are shipped from our stock and manufacturing warehouse located in Browns Plains, Queensland. If for any reason, your order, or part thereof, cannot be shipped you will be notified promptly. Order in stock are dispatched within two business days, from the time that payment has been received in full, and delivery time is estimated to be between 2-12 business days depending on your location. If you are not available, when our delivery partner attempts a delivery, a card may be left advising you that your order will be available for you to collect from your local depot. We are not held responsible for our delivery partners’ failure to deliver but will assist you where possible.

Shipping cost is calculated per item at a flat rate for Australia wide delivery. International freight is calculated on an individual basis.

Product Failure claims must be made within 12 months of purchase and only by the original purchaser.

In the event of a Product Failure:

• The product must be returned to Tremaniac Racing in its failed state so Tremaniac Racing can determine the reason of failure;
• Product Failure caused by Engine malfunction / trigger errors are not covered by Warranty;
• If Products are tampered with, or modified in any way, they will not be covered by Warranty.

All warranty claims must be made within 30 Days from the date of purchase and only by the original purchaser.

The Company will assist you with product returns and provide you with a refund, exchange or repair where:

• The product is received faulty or is not of acceptable quality prior to installation; or
• The product is not fit for its intended purpose; or
• The product does not match the description; and
• You can present your Tremaniac Racing proof of purchase.

Note: The surface of our products are a CNC machined finish. This means tool machining lines and tool lift, engagement and distribution points are present and are considered normal features which and add to the beauty of the product.

You do not have the right to return a product when:

• Change your mind.
• Ordered the wrong product.
• Found the product cheaper elsewhere.
• The product has been installed.
• The product was sold as a clearance or reduced item.
• Damaged the product by misusing or incorrect fitment.
• The product has developed problems due to wear and tear.

The Company is not responsible for chassis fitment or fitment with other products unknown to the Company. This includes but is not limited to – sump to chassis component clearance, accessory mounting, vehicle wiring.

The use of our products is for motorsports and / or performance competition purposes, which in most circumstances, is contrary to the original equipment manufacturer’s design specifications and not in accordance with the original equipment manufacturers instructions. Due to the nature of the motorsports and performance environment, the life expectancy of components and engines cannot be defined, therefore are sold with an extremely limited warranty. With this in mind, products and services are used at the purchasers discretion.

For the purpose of this warranty, motorsports is classified as any automotive activity that takes place on or off a public road in a performance / competitive environment. All products and services purchased from The Company are sold with the expectation of use within a motorsport activity. The warranty is limited to the components being free from defects in material and workmanship at the point of sale only. The purchaser takes the entire risk to the quality and performance of all products and services. The purchaser has the final decision to use the product, should the purchaser decide not to use the product, immediately follow the return procedures described within these Terms and Conditions.
